Some have argued that as long as producers use industrial hemp, legally imported from foreign sources, and the CBD product is extracted from that, it is legal. The use of imported hemp is heavily regulated, and even if such extraction processes were not, in themselves, a violation of federal law, products is cbd addictive containing even trace elements of THC would be. Last, the quality control (including testing) and label requirements for both medical and recreational are quite uneven and may be non-existent in some states (Klieger et al., 2017). Some states—like California (recreational and medical)—require laboratory testing of cannabis and cannabis products to make sure that they meet quality and safety standards, while other states—such as Arizona (just medical)—do not have state-mandated testing (Milley, 2018). Since, for prescription medications, these requirements are generally determined by FDA, it may be challenging for states to develop such requirements and to find adequate resources to enforce them. However, a number of international standard-setting organizations, such as ASTM and AOAC, are engaged in developing standards for the testing, quality control, etc., of cannabis and cannabis products.
Is cannabis legal in Texas?
A. FDA is aware of some cannabis products being marketed as animal health products. We want to stress that FDA has not approved cannabis for any use in animals, and the agency cannot ensure the safety or effectiveness of these products. Dermal Effects of Cannabinoids on Pain and Inflammation

Cannabidiol (CBD) is not considered a ‘narcotic drug’ under European law
The local application of cannabinoids could be a strategy directed to modulate these cell functions while avoiding the central undesirable effects. Cannabinoids, mostly through CB2 receptors, reduce the production of proinflammatory factors and the migration of leukocytes to the site of injury or into the brain under inflammatory conditions24-28 (Table 3). These findings are of particular relevance because the invasion of peripheral immune cells (neutrophils or lymphocytes) into the CNS contributes to the development of inflammatory and neuropathic pain conditions.29, 30 Pain modulation via CB2 receptors is also exerted through other nonimmunologic mechanisms. For example, peripheral CB2 activation can reduce pain-related behaviors in rodents by inducing the release of peripheral opioids from keratinocytes.31 This mechanism of action of CB2 agonists argues for the efficacy of the local application of these compounds for localized peripheral pain conditions. The relevance of the endocannabinoid system in pain modulation has been extensively described.

Substances

Courts have largely afforded DEA broad latitude in controlling substances derived from the cannabis plant. The DEA’s stance, all along, has been that cannabinoids are marijuana and thus are a Schedule I substance and illegal in all circumstances. Marijuana reformers often point to Hemp Industries Association v. DEA to say that non-psychoactive hemp is not a controlled substance. While the judge in that case ruled that not all cannabis plants fall under the Controlled Substances Act, most courts, including the cases U.S. v. Plume (2006), U.S. v. Proyect (1993), and U.S. v. Spann (1975), have held just the opposite.
This alert warns consumers about the potential for adverse events due to insufficient labeling of products containing THC and CBD. The Industrial Hemp Regulations under the Cannabis Act set out the requirements for cultivators of industrial hemp. As is currently the case, cultivators of industrial hemp must grow from the hemp varieties approved for commercial cultivation. Under the Cannabis Act, CBD products remain strictly regulated and are only legal when sold in compliance with the Act and its regulations. Hepatic ImpairmentThe starting dose of XYWAV should be reduced in patients with liver impairment. Geriatric UseIn general, dose selection for an elderly patient should be cautious, usually starting at the low end of the dosing range, reflecting the greater frequency of decreased hepatic, renal, or cardiac function, and of concomitant disease or other drug therapy.
The law allows the production, manufacture, retail sale and inspection of industrial hemp crops and products in Texas, granted that they stay at 0.3% or less delta-9 THC level. This also includes products for consumable hemp products that contain cannabidiol (CBD), as well as other edible parts of the hemp plant. Although many people use CBD as a wellness-boosting substance, there are some who do not share that opinion. Some concerned people worry that CBD could be addictive, while others worry it’s a gateway drug that alcoholism treatment will lead to harder substances.
